Si tu as d'autres questions, tu peux voir cette page ou bien me contacter.

Pictures deleted in the article Philippe Samyn

[modifier le code]

Dear Cecil, I am the one who uploaded Philippe Samyn's work pictures. Philippe Samyn is the owner of those picture and he allowed me to publish them on wikipedia. Though, I know that when I uploaded them I had to choose a license but didn't know which one to choose (the best would probably have been copyright...)... You can perhaps help me. I would also like to know how if it is still possible to cancel the suppression of the pictures so that I don't need to spend hours uploading them again.

If you want to contact Ph. Samyn to verify his agreement: here are the informations: Tel. +32 2 374 90 60 - email: SAI@samynandpartners.be

Sicerely,

Bertrand Velu bertrand.velu@ulb.ac.be +32 479 22 91 55

Hi! I does not matter if Philippe Samyn is the owner of the photographs. He has to be the photographer to be able to give that permission. If he is the photographer then he has to decide which licence it should be (not you). And two things he should now: 1. it is not possible to use a free licence and only allow usage in wikipedia at the same time. The restriction to use images only at Wikipedia is not possible (pictures that have this restriction are not free and can't be used in any of the wikimedia projects). 2. it is not possible to retract a licence later.
It is possible to restore deleted images, but it is only done after the problems that led to the deletion are solved.
And sorry, I don't have the money to phone through the world for getting verifications. Next thing is that everybody should be able to see a verification. I'm pretty sure Ph. Samyn would not like it if he gets a few phone calls every day asking for verification. Therefore we have the OTRS. He would have to send a email to that address, confirming that he is the photographer of the images and not only have the images in his possession but also be the copyright owner. He then has to specify a licence and declare that he knows the content of that licence and knows that his images can be used for everything (that includes commercial use outside of the Wikimedia projects) and that it is not revoceable. You/he can find a few templates at the link which should be used for it. -- Cecil (d) 9 novembre 2008 à 23:53 (CET)[répondre]

Dear Cecil,

I will try to contact Mr Samyn to ask him what kind of license he prefers...

Ph. Samyn is indeed not the photographer, however, as far as I remember, he bought the 'right' or license on those pictures so that he can publish them without paying any additional amount to the photographer. If I understand you point, his claim on the pictures is not enough for me to publish them on wikipedia, even with his agreement. I should thus contact the photographer and ask her to write a note giving her agreement. If they both allow me to publish those pictures (I mean, they would do it in my presence), Is there any way to publish a picture on wikimedia (that can indeed be used outside wikipedia) but so that the owner remains Ph. Samyn or the photographer? Or anyway to require a citation of the artist in any case of publication outside wikipedia? What kind of licence do you suggest us to use? (Is copyright allowed on wikipedia or only copyleft?)

Thanks in advance,

Bertrand Velu

If he really bought the right to decide all those things which is quite possible if the contract was created that way (I also give away most of my rights of my work to my boss) than he naturally can select the licence alone and you do not need to write to the photographers. So if he tells that than you are save with just his permission. But don't forget that we need that in a written form (sent to COM:OTRS).
With free licences like CC-by-sa and GFDL the author has to be attributed. The recommended licence if you don't want to give away all rights would be CC-by-sa for pictures (GFDL is better for text). In this case you give away to other peoples the rights to use them however they want (also for commercial work) and to change them (naturally not use them in a way that harms or offends anybody). As exchange for using the images for free the re-user has to attribute the photographer and has to put the work based on the pictures under the same licence (which more or less prevents somebody just taking the image and selling it). At Licence_Creative_Commons you can find more information about the licence. There are two more licence options - the 'non-commerical' (nc) and 'non-derivative' (nd), but images with those two options cannot be used at Commons. -- Cecil (d) 11 novembre 2008 à 18:34 (CET)[répondre]

Dear Cecile,

I will try to contact Ph. Samyn when I have time. Thanks for all the details you provided me with. I wish you a good evening.

Sincerely,

B. Velu
